Join Me at the Top Producer Seminar in Nashville from January 23-25, 2023, Where I Will Be Speaking about Why Prenups Should be Destigmatized and Included in Standard Planning, Gift and Estate Tax Matters, How Portability Impacts Succession Planning, and (as Part of a Panel) How to Keep the Balls in the Air
Prenups are not just for the Hollywood rich and famous. They are more important for farm families, who have strong emotional ties to the land/operations.
Who cares if an heiress loses half of the millions in her investment portfolio? But if a farmer loses half the machinery and land base, how will he keep going?
Prenups need to be destigmatized and considered part of an overall succession plan. They are also crucial for remarriages during the golden years, and to have the flexibility to plan an income stream for a surviving spouse, while protecting ultimate ownership for biological children, without the risk of a spousal election to take assets at death.
Additionally, children and grandchildren who will inherit farm assets may incorrectly think they don’t need a prenup because they don’t have any assets yet. But one day your assets will be on their balance sheet, and a prenup can identify any family farm assets as being off the table during a divorce, or being eligible for election at death.
In considering succession planning, farm families must carefully balance asset transfer/portability and tax minimization objectives in order to develop a plan that will best accomplish these goals. I will be speaking about these considerations and providing a framework that can be considered by farm owners.
I’ll also be joining a panel during the Executive Women in Ag Track, discussing key ideas that help busy people “keep all the balls in the air” (and I’m looking forward to sharing some tips for my own hectic life!).
